Terms of Use

1. General Provisions.
These Terms of Use ("Terms") govern access to and use of the Rawpool platform, including its website, applications, software, and related services (the "Platform"). By creating an account, using the Platform, or entering a challenge, you agree to these Terms and the current Official Rules. If you do not agree, do not use the Platform.
2. Description of the Platform.
Rawpool enables participants to enter skill-based challenges and complete published requirements. Results are determined by completion, review, and compliance with the applicable Official Rules. No winner is selected by random draw, luck, or chance. Rawpool does not offer or facilitate gambling, wagering, betting, lotteries, raffles, sweepstakes, casino games, or other games of chance.
3. Eligibility and Accounts.
You must be at least eighteen (18) years old to participate. You represent that your participation is permitted where you live and that information you provide is accurate. Each participant may use only one Rawpool account to enter a challenge. Rawpool may restrict, suspend, or terminate access where it reasonably believes these Terms or the Official Rules have been violated.
4. Official Rules and Challenge Participation.
The current Official Rules form part of these Terms for challenge participation. They describe challenge requirements, submission review, appeals, eligibility, prize calculation, payout status, cancellation, and refunds. Rawpool records acceptance of the current Terms and Official Rules when required for challenge entry; prior acceptance records remain associated with the version accepted at that time.
5. Payments, Platform Fee, Cancellations, and Rollovers.
Before payment, each challenge displays the Challenge Entry, the Rawpool Platform Fee, and the total amount due.
The Rawpool Platform Fee is between 18% and 20% of the Challenge Entry. The exact Platform Fee applicable to a Challenge is displayed before payment and is charged separately from the Challenge Entry.
100% of successfully collected Challenge Entry amounts, excluding refunded, reversed, or charged-back payments, are allocated to that challenge’s prize pool. Rawpool retains the Platform Fee to cover payment processing, platform operations, administration, moderation, challenge development, and other Rawpool costs. Payment-processing costs are not deducted from the participant-facing prize pool.
For example, with a $40 Challenge Entry and a 20% Platform Fee, the Platform Fee is $8, for a total of $48 before any applicable taxes or government charges. The full $40 Challenge Entry is allocated to the prize pool.
Entry is non-refundable after successful registration except when Rawpool cancels the challenge. If Rawpool cancels a challenge, eligible successfully collected amounts paid for that challenge are refunded in full, and Rawpool does not retain the Platform Fee from those cancelled-challenge payments.
If a challenge ends with no eligible winners, its final distributable prize pool rolls over as described in the Official Rules. A zero-winner outcome is not a cancellation and does not create participant refunds. Eligible rollover amounts are not subject to an additional Platform Fee.
Rawpool uses independent third-party payment processors and does not store complete payment-card information.
6. User Content.
Users may submit permitted content, including Instagram Reel URLs, profile images where enabled, text, and other permitted materials ("User Content"). You represent that you have the rights needed to submit User Content and that it is truthful, accurate, and relevant to the applicable challenge. You retain ownership of User Content. You grant Rawpool a worldwide, non-exclusive, royalty-free license to use, store, display, process, reproduce, and publish User Content solely to operate the Platform, administer challenges, verify submissions, and promote the Platform.
7. Suspension and Challenge Integrity.
Rawpool may suspend, restrict, or terminate access, invalidate challenge results, or revoke prize eligibility where it reasonably believes a user has violated these Terms, the Official Rules, applicable law, or the integrity of a challenge. Any such action will be taken consistently with the Official Rules and applicable law.
8. Third-Party Services.
The Platform may link to or integrate with third-party services, including Instagram and payment providers. Rawpool does not control those services, and their availability and use are governed by their own terms and policies.
9. Disclaimer of Warranties.
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RAWPOOL DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR AVAILABLE AT ALL TIMES, OR THAT PARTICIPATION WILL RESULT IN A PRIZE OR ANY PARTICULAR OUTCOME.
10. Limitation of Liability.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RAWPOOL AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND PARTNERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM USE OF THE PLATFORM, PARTICIPATION IN A CHALLENGE, THIRD-PARTY SERVICES, OR TECHNICAL FAILURES.
IN ANY EVENT, RAWPOOL'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE APPLICABLE ENTRY FEE PAID BY YOU FOR THE CHALLENGE GIVING RISE TO THE CLAIM.
11. Indemnification.
You agree to defend, indemnify, and hold harmless Rawpool and its owners, employees, contractors, affiliates, and representatives from claims, liabilities, damages, losses, costs, and expenses arising from your violation of these Terms, the Official Rules, applicable law, third-party rights, or misuse of the Platform.
12. Governing Law and Dispute Resolution.
These Terms are governed by the laws of the jurisdiction in which Rawpool is incorporated, without regard to conflict-of-law principles. The parties will make reasonable efforts to resolve disputes through good-faith negotiations before initiating legal proceedings, unless applicable law requires otherwise.
13. Severability and Entire Agreement.
If any provision is invalid or unenforceable, the remaining provisions remain effective. These Terms, the Privacy Policy, and the applicable Official Rules are the entire agreement governing your use of the Platform. If there is a conflict, the applicable Official Rules control for that challenge.
14. Changes to These Terms.
Rawpool may update these Terms from time to time. The current version will be published on the Platform. Continued use after an effective revision constitutes acceptance to the extent permitted by applicable law.
